1 North Carolina worker killed, 2 others injured

One construction worker was killed and two others were injured by a car accident that occurred in Morganton on Sept. 19. The incident happened around 4:30 a.m. on Interstate 40 near Highway 18. The three workers were paving the roadway within a construction work zone when they were struck by a westbound Ford pickup truck driven by a 37-year-old man.

A 43-year-old worker was pronounced dead at the scene of the accident. A 23-year-old worker injured in the crash was brought to Grace Hospital before being released. A 34-year-old worker was more seriously injured and was transported to Carolinas Medical Center. Investigators determined that speed and alcohol were not contributing factors in the incident. On Sept. 22, highway troopers were expected to present the distract attorney with any criminal charges that could be filed against the driver.

The two surviving construction workers may consider contacting a lawyer if they have any trouble receiving the appropriate benefits and coverage after filing workers' compensation claims. Workers' compensation lawyers could help these victims seek adequate compensation, such as medical expenses and potentially a portion of their lost income.

While filing a workers' compensation claim following an on-the-job injury will prevent an injured worker from taking any further action against the employer, the prohibition does not extend to third-party personal injury claims. If a third party, such as a driver traveling through a construction zone, causes a worker to suffer injuries, the worker could hold the third party accountable in civil court for any injury-related expenses that are not covered through the workers' compensation insurance system.
